FAQ
Common questions
How can a foreign company set up a presence in India?
Common routes are a subsidiary company, a limited liability partnership (subject to FDI policy), or a liaison, branch or project office. The right choice depends on the activity, sector, ownership and FDI conditions. We help you compare options and complete incorporation and registrations.
Does an NRI need to file an Indian income tax return?
It depends on the nature and amount of income arising in India, tax already deducted, and whether refunds or loss carry-forwards are being claimed. We review your situation and confirm what is required.
Does an OCI card make me a resident for tax purposes?
Income-tax residential status depends on the days you spend in India and other tests under the law, not on your citizenship or OCI status. FEMA rules on investments are a separate question we can also advise on.
What is Form 146 (earlier Form 15CB)?
Form 146, earlier known as Form 15CB, is a chartered accountant’s certificate under the Income-tax Act, 2025 (in force from 1 April 2026). It is needed when a taxable payment to a non-resident (not being a company) or a foreign company exceeds ₹5 lakh in the tax year and no certificate has been obtained from the Assessing Officer. It supports the remitter’s Form 145 (earlier Form 15CA). We review the documents, the taxability and any tax-treaty rate, and certify where the conditions are met. Please check the forms currently notified for your case.
Can we speak across time zones?
